GMA Network seeks review of COMELEC Resolution No. 9615

GMA Network, Inc. (“GMA” or “the Network”) expressed serious concerns and reservations on certain provisions of Resolution No. 9615, (the Rules and Regulations Implementing Republic Act No. 9006 otherwise known as the ‘Fair Election Act’) (the “New Rules”), affecting the broadcast industry.

In a letter dated January 23, 2013, GMA, through its Chairman and CEO Atty. Felipe L. Gozon, Consultant to the Chairman and CEO Pacifico A. Agabin, Vice President for Legal Affairs Atty. Ma. Luz P. Delfin, and Belo Gozon Elma Parel Asuncion and Lucila Law Office urged the Honorable Commission to recall and revisit said provisions based on certain procedural and substantive concerns.

GMA raised its concern on the manner of passage of Resolution No. 9615 as COMELEC did not conduct any public hearing especially among those affected by the resolution. GMA noted that the Omnibus Election Code of the Philippines requires due notice to all interested parties as well as an opportunity for the same to be heard.

Considering that substantive rights of various parties shall be affected by the New Rules, GMA questioned the propriety of its promulgation without public participation.

Calapan City Prosecutor dismisses libel charges against Howie Severino and GMA News Research head

The Office of the City Prosecutor of Calapan, Oriental Mindoro, dismissed a complaint for libel filed by Doctor Idol Bondoc of the Oriental Mindoro Provincial Hospital (OMPH) against GMA News Online Editor-in-Chief and GMA News and Public Affairs personality Howie Severino, and GMA News Research Head Florian Balmes for insufficiency of evidence.

Bondoc filed a complaint against Severino, Balmes, and his colleague, Dr. Rosinico Fabor, last September 5, 2011 after Fabor posted allegedly defamatory remarks on the comments section of a GMA News Online website article regarding the Ombudsman’s decision on a previous administrative case involving Bondoc. It was claimed by Bondoc that GMA News Online served as a vehicle for Fabon to destroy his reputation as a medical professional, and that he was not given equal opportunity to air his side of the story.

In the Resolution dated November 13, 2012, Deputy City Prosecutor Gabriel C. Alberto noted that the comments made by the readers of GMA News Online were not edited or subjected to prior approval before posting. Considering that neither Severino nor Balmes had the power to edit or approve comments on the website, and considering further that sufficient guidelines on proper posting of comments were available on the website, it was determined that they should not be held liable for any reactions sent by its readers.

Meanwhile, City Deputy Prosecutor Alberto found probable cause to charge Dr. Fabon with libel and recommended the filing of the corresponding information in court.

Revisiting I-Witness' 'Kubling Yaman ng Cama Juan'

There are hidden riches in the far-flung farming community of Nueva Ecija. Such was the premise of Sandra Aguinaldo's documentary "Kubling Yaman ng Cama Juan," which aired last year on GMA-7's I-Witness.

In the documentary, Sandra went to the remote barangay of Cama Juan in San Antonio, Nueva Ecija where she met five friends bound for college after graduating in a public high school. Camille Basilio, Arlene Ramos, Jessica Duran, Jerick Marin, and Mherry Camarota were honor students of their graduating batch in Zacarias Aquilizan High School. Their teachers call them "kubling yaman"-students with hidden exceptional potential, but lack the final touches that would make them truly stand out.

Son and daughters of fishermen, all five friends knew that finishing college would provide them a ticket to a better future. But they were also aware that it would take more than their passion for learning to put them through college. In a country where education ends up being a privilege to a few, Camille and her friends knew that their dream may never become a reality.
